1 This Privacy Policy
(1) This Privacy Policy applies to all personal information collected by Alysse Di Natale (ABN 53 930 369 951) trading as Meditate With Friends (hereinafter referred to as MWF) and describes how MWF collects, uses and discloses your personal information.
(2) MWF operates a business through the Site which provides guided meditation for children by children (Goods and Services).
(3) Please read this Privacy Policy carefully, as by:
(a) accessing the website https://meditatewithfriends.com.au as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected to ‘Mediate with Friends’ (Site); and
(b) using the Goods and Services,
you are confirming that you have read this Privacy Policy and understand how your personal information will be handled by MWF.
(4) Should you not agree with this Privacy Policy, you should immediately cease accessing and using the Site and the Goods and Services.
(5) This Privacy Policy does not apply to the third-party online/mobile stores from which you install any part of the Site and payment processors when you make payments, which may also collect and use personal information. MWF is not responsible for any of the personal information and dated collected by any such third party. MWF suggests you review those third party’s privacy policies.
(6) MWF respects the rights and privacy of all individuals and is committed to complying with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APP’s) as well as protecting the personal information that MWF holds.
2 What is ‘personal information’?
(1) The Privacy Act defines ‘personal information’ as meaning information or an opinion about an identified individual or an individual who is reasonably identifiable:
(a) whether the information or opinion is true or not; and
(b) whether the information or opinion is recorded in a material form or not.
(2) If information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as ‘personal information’ and will not be subject to this Privacy Policy.
3 What personal information does MWF collect?
(1) MWF collects the types of personal information required to assist MWF in operating the Site, providing the Goods and Services and otherwise in fulfilling MWF’s general functions and activities with respect to the Site and the Goods and Services. This includes personal information such as:
(a) contact and identification details such as your name, date of birth, gender, photo, location, phone number, email and address;
(b) information about your use of our Goods and Services;
(c) financial information such as your bank account details, credit card details or other billing information;
(d) technical information, interactive, derivative, tracking and location data and log data in connection with the Site, which includes, but is not limited to, your device type, any user ID, operating system information, device identifiers, system performance information, browser type, internet service provider, internet protocol address, date/time stamps and aggregate user statistics;
(e) information to assist our relationship management and market research functions, which may include information relating to your interests, experiences and preferences; and
(f) any other personal information that you provide to MWF.
(2) Please note that if you choose to, or otherwise consent to, share personal information through your account or otherwise on the Site, all information that you disclose is public and your information will be accessible to anyone who accesses the Site.
4 How does MWF collect information?
(1) MWF collects personal information about an individual:
(a) from that individual directly which is:
(i) voluntarily supplied to access and use the Site and Goods and Services; and
(ii) tracking and technical information MWF collects when accessing and navigating through and use the Site (for example, by way of cookies, beacons, tags, and scripts);
(b) from publically available sources; and/or
(c) from other third party persons or organisations.
(2) If you provide personal information about another person to MWF, MWF requires that you inform that person that you have done so and provide them a copy of this Privacy Policy.
5 How does MWF use your personal information and who may MWF disclose it to?
(1) MWF will use personal information you provide for the primary purposes of:
(a) the purposes for which it is collected;
(b) informing you about the Site and the Goods and Services and improving, personalising and customising your experience on the Site and your use of the Goods and Services;
(c) improving MWF’s business and to administer, manage and enhance the Goods and Services;
(d) using that information as part of the provision of the Site and the Goods and Services and fulfilling MWF’s functions and activities with respect to your access and use of the Site and the Goods and Services; and
(e) administering MWF’s relationship with you by:
(i) communicating with you; and
(ii) providing you with information about the Site and the Goods and Services that may be of interest to you.
(2) MWF may use and disclose your personal information for secondary purpose related to the primary purposes set out in paragraph (1).
(3) MWF may also disclose your personal information to third party service providers who are required to assist MWF in fulfilling its functions and activities with respect to your access and use of the Site and the Goods and Services.
(4) MWF may also use and disclose your personal information to governmental or regulatory authorities upon request being made.
(5) Otherwise, MWF will not disclose your personal information to any third party unless otherwise having obtained your prior consent.
(6) By submitting your personal information, you consent to MWF using it to:
(a) provide you with full and proper access and use of the Site and the Goods and Services and fulfil MWF’s functions and activities with respect to your access use of the Site and the Goods and Services;
(b) administer MWF’s relationship with you, including communicating with you with respect to the Site and the Goods and Services;
(c) monitor activity on the Site and in relation to the Goods and Services;
(d) market, improve and add to the Site and the Goods and Services;
(e) allow third party service providers required to assist MWF in fulfilling its functions and activities with respect to your access and use of the Site and the Goods and Services;
(f) respond to a serious threat to an individual’s life or to public health or safety;
(g) respond to suspected unlawful activity; or
(h) where required or authorised by law.
6 Will you receive direct marketing?
(1) Yes, you authorise MWF to send you promotional messages and materials related to the Site and the Goods and Services, unless you submit a request not to receive direct marketing communications.
(2) MWF’s direct marketing messages and materials will contain a prominent statement (including, for electronic messages, a functional unsubscribe facility) allowing you to unsubscribe from receiving direct marketing communications.
(3) If you do not wish to receive marketing or other communications from MWF, please submit a request not to receive direct marketing communications or use the unsubscribe facility provided in the most recent marketing communication from MWF or otherwise contact MWF.
7 Will your information be disclosed overseas?
(1) MWF will send your personal information overseas and collect personal information from overseas in the following instances:
(a) When you have asked MWF to do so or MWF has your consent.
(b) When MWF are authorised or required by law or a court/tribunal to do so.
(c) When MWF has outsourced a business activity or function to an overseas service provider.
(d) Certain electronic transactions.
(2) MWF will disclose personal information overseas but only to the extent it is necessary to perform its functions or activities.
8 How can you access and correct your personal information?
(1) You generally have the right to access your personal information free of charge, subject to some limitations contained in the Privacy Act.
(2) The APP’s set out some circumstances in which MWF is not required to provide you with such access. If you ask for your personal information and any of these circumstances exist, you may be given access to the personal information in a way that is permitted under the Privacy Act.
(3) To protect personal information held by MWF, you may need to confirm your identity before access to your personal information is granted. It may take a time to process your application and access and retrieve information.
(4) MWF encourages you to update MWF with accurate, current and complete information. You may correct any errors or request that MWF delete all or some of your personal information in accordance with the Privacy Act.
9 Can you remain anonymous?
Where practical, you may choose not to identify yourself and deal with MWF on an anonymous basis or use a pseudonym. However, if you do not provide MWF with required personal information MWF may not be able to provide you with access to and use of the Site and the Goods and Services.
10 Security
MWF will take all reasonable precautions to ensure that your personal information is secured and is not misused, interfered with, altered or otherwise unlawfully accessed.
11 How can you complain about privacy breaches?
(1) If you have a complaint in relation to the collection, use and/or disclosure of your personal information, please contact our Privacy Officer via the details provided at section 14 below.
(2) MWF’s Privacy Officer will review all complaints received and respond to each complainant upon due consideration (which may require you to provide further information).
(3) If MWF agrees that your complaint is well founded, MWF will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.
12 Will this Privacy Policy change?
MWF may amend this Privacy Policy from time to time. Amendments will be effective immediately upon notification on the Site. You will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Site after the date such revised Privacy Policy is posted.
13 GDPR and UK-GDPR
13.1 Application of the General Data Protection Regulations
(1) This section of the Privacy Policy only applies if you use and access the Site or the Goods and Services within the European Union or the United Kingdom.
(2) In the event that this part of the Privacy Policy conflicts with any other part of the Privacy Policy, the terms of this part will prevail.
13.2 Principles of processing your Personal Data
MWF processes your Personal Data (as defined in the General Data Protection Regulation and United Kingdom General Data Protection Regulation) in accordance with the principles of data processing set out in the GDPR and UK-GDPR including, but not limited to, processing your Personal Data:
(1) in a manner that is lawful, fair and transparent;
(2) for specified, explicit and legitimate purposes;
(3) to the extent that it is adequate, relevant and necessary for the specified legitimate purposes;
(4) in a manner that maintains the accuracy of the Personal Data;
(5) for no longer than is necessary;
(6) in a secure and safe fashion; and
(7) with accountability.
13.3 Purposes for processing your Personal Data
(1) MWF processes your Personal Data for the intended purposes specified in section 5 of this Privacy Policy or for any other purpose compatible with those specified purposes.
(2) In the event that MWF intends to process your Personal Data for any other purpose, MWF will obtain your consent for the processing of your Personal Data for that new purpose or otherwise rely on another lawful basis to process your Personal Data.
13.4 Lawful basis for processing your Personal Data
(1) MWF’s valid lawful basis for processing your Personal Data is your voluntary informed consent to the processing of your Personal Data for the specific purposes stated in this Privacy Policy. You have provided your consent by positively opting into the terms of this Privacy Policy.
(2) You have the right to withdraw your consent to the processing of your Personal Data at any time.
(3) MWF can determine one (1) or more of the following lawful basis to process your Personal Data for any additional purposes not specified in this Privacy Policy:
(a) To perform or enter into any contract MWF has with you.
(b) To comply with a legal obligation to which MWF is subject.
(c) To protect your vital interests or that of another person.
(d) MWF’s legitimate interests in providing its Goods and Services to you.
13.5 Your rights
You may exercise the following rights (if applicable) on the terms permitted by the GDPR or UK-GDPR:
(1) The right to be informed about information in relation to your Personal Data.
(2) The right to access your Personal Data.
(3) The right to rectify inaccurate Personal Data.
(4) The right to have your Personal Data erased, subject to any legal obligations we have to retain your Personal Data.
(5) The right to restrict the processing of your Personal Data.
(6) The right to receive your Personal Data and to have it transmitted to a third party.
(7) The right to object to your Personal Data being processed.
(8) The right to object to automated decision making.
13.6 Data breach
(1) MWF will advise the relevant supervisory authority of a data breach within seventy-two (72) hours of becoming aware, unless the breach is unlikely to result in a high risk to your rights and freedoms.
(2) In the event that the data breach is likely to result in a high risk to your rights and freedoms, MWF will also notify you without undue delay.
